However, today’s post is important for New York cosmetologists who perform eyebrow and eyelash tinting services and the clients who receive them.

On August 27, 2024, The New York State Division of Licensing emailed licensed cosmetologists informing us we can add eyebrow and eyelash tinting to our services. This regulation permits products that contain silver nitrate color additives, which must follow federal guidelines, taking effect September 4, 2024.

However, they failed to update who could perform said services and sent a revised email clarifying who could not conduct eyebrow and eyelash tinting services, emphasizing ONLY NEW YORK STATE LICENSED COSMETOLOGIST CAN OFFER EYEBROW AND EYELASH TINTING SERVICES WITH SILVER NITRATE PRODUCTS.

THE FOLLOWING SERVICE PROFESSIONALS WITH THE LICENSES BELOW CAN NOT APPLY EYEBROW AND EYELASH TINT:

  • Natural Hair Styling 
  • Esthetics 
  • Nail Specialty 
  • Waxing

What Are Silver Nitrate Color Additives?

Silver nitrate is an inorganic chemical compound, which could cause adverse reactions on the skin if not used as directed. As a color additive, it creates a darker stain or color for eyebrow and eyelash tinting. The FDA issued directives on how much is to be used in a gel color compound, limiting it to 4% by weight. In addition, recommended usage is for individuals over the age of 16. The application should be limited to one minute and removed immediately.

Licensed professionals in New York State who might have deleted the emails can send questions to Beauty@dos.ny.gov.

Clients who would like their eyebrows or eyelashes tinted should ask for the type of license their servicer has at the time of booking. Then, during the appointment ask to see it if it is not readily visible. New York State requires all licenses to be on display for the guests. Remember, only professionals with a full cosmetology license can perform this service.

In addition, ask if the eyelash or eyebrow tint is a silver nitrate color additive. The professional should know. New York State and OSHA require documentation for all products used in salons known as SDS or Safety Data Sheets. This is safety and product information supplied by the manufacturers given to the salons. As a result, they must be readily available in either paper or digital format. The more you know!
